¿Por qué pueden rechazarte el REPSE?

1. Objeto social no relacionado con el servicio que ofreces

  • Si el objeto social en tu acta constitutiva o ante el SAT no coincide con el servicio u obra especializada que pretendes registrar, la STPS lo rechazará.

  • 📄 Fundamento: Art. 13 de la LFT – el servicio debe estar dentro del objeto social del prestador.

  • 🛑 Ejemplo: Ofreces servicios de mantenimiento industrial pero en tu objeto social solo aparece “comercio de artículos de limpieza”.

2. Actividad económica registrada en el SAT no coincide

  • La STPS valida que la actividad económica registrada ante el SAT esté alineada con el servicio que describes en el REPSE.

  • 🛑 Ejemplo: Si registras “servicios de instalación eléctrica” pero tu actividad fiscal es “comercio al por menor de ropa”, será rechazado.

3. Opiniones de cumplimiento negativas (SAT, IMSS o INFONAVIT)

  • El sistema automáticamente rechaza si alguna de estas instituciones tiene opiniones negativas o no vigentes.

  • 📄 Fundamento: Acuerdo DOF 24/05/2021 – requisitos para el REPSE.

  • ✅ Solución: Consulta y corrige antes en los portales del SAT, IMSS e INFONAVIT.

4. Falta de personal propio

  • La STPS presume que una empresa sin empleados registrados no puede prestar servicios especializados.

  • 🛑 Ejemplo: Una persona física sin trabajadores registrados en el IMSS quiere registrarse para ofrecer servicios de construcción.

5. Contrato mal redactado o inexistente

  • Debes adjuntar un contrato de prestación de servicios con un cliente (aunque sea de ejemplo). Si está incompleto o mal redactado, será rechazado.

  • 📄 Fundamento: Art. 15 de la LFT – el contrato debe incluir datos del REPSE y del servicio.

6. Uso incorrecto de giros genéricos o no especializados

  • La STPS puede considerar no especializado un servicio si es muy genérico.

  • 🛑 Ejemplo: “Servicios administrativos” o “consultoría general” sin especificar una especialización técnica o profesional.

7. Errores en la carga de documentos

  • Documentos ilegibles, mal firmados o con errores (RFC incorrecto, archivos corruptos) causan rechazo automático.

  • ✅ Consejo: Escanea en buena calidad, revisa que los documentos estén firmados y actualizados.

8. No demostrar diferenciación frente al cliente

  • Si el servicio que prestas es igual o parte del giro principal del cliente, se considera subcontratación prohibida.

  • 📄 Fundamento: Art. 12 LFT – prohibición de subcontratación de actividades principales.

9. No contar con firma electrónica vigente (e.firma)

  • Sin e.firma activa, no se puede concluir el trámite en el portal REPSE.

  • 🛑 Ejemplo: E.firma vencida o revocada, tanto para personas físicas como morales.

10. No acreditar capacidad técnica o experiencia

  • En algunos casos, la STPS puede pedir evidencia de la capacidad técnica o experiencia previa.

  • 🛑 Ejemplo: No tener ningún contrato ni experiencia comprobable en el giro solicitado.
